No contract exists between the Customer and Book Hyperstore for the sale of any goods until Book Hyperstore has received and accepted your order, has received payment in full (in cleared funds) and the order has been shipped. Once Book Hyperstore does so, there is a binding legal contract between us. By way of clarification, an acknowledgement of your order will be sent to you via e-mail when you place your order, but acceptance of your offer to buy the goods will not take place until after your payment is taken and you receive an email confirming that your order has been shipped. It is at this point that a binding legal contract is created and any contract is subject to these Terms and Conditions.
The goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, Book Hyperstore will inform you as soon as possible and you may request to cancel the order. Should you cancel the order, Book Hyperstore will refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods. We reserve the right to cancel an order with a full refund at any time at our discretion.
Goods are sold for personal use only, and may not be resold or hired out. Goods are not permitted to be exported outside of South Africa.
Every effort is made to ensure that prices shown on Book Hyperstore website are accurate at the time you place your order. Book Hyperstore reserves the right to amend any quoted prices including the shipping charges at any time prior to despatch. If an error is found, Book Hyperstore will inform you as soon as possible and offer you the option of reconfirming your order at the correct price, or cancelling your order. If Book Hyperstore does not receive an order confirmation within 14 days of informing you of the error, the order will be cancelled automatically. If cancelled, Book Hyperstore will refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.
Payment for the goods and delivery charges can be made by any method shown on the Book Hyperstore website at the time you place your order. Payment shall be due before the delivery date and time for payment shall be of the essence. There will be no delivery until cleared funds are received.
Every effort will be made to deliver the goods as soon as possible after your order has been accepted. However, Book Hyperstore will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. In this case, Book Hyperstore will inform you as soon as possible. Time for delivery shall not be of the essence. The goods may be delivered by Book Hyperstore in advance of the quoted delivery date. If delivery cannot be made to your address for reasons under Book Hyperstore control, we will inform you as soon as possible.
Once the goods have been received, it is the responsibility of the customer to check the goods and let Book Hyperstore know within 48hours of any problems. If incorrect goods have been received, Book Hyperstore will arrange for collection of the goods and delivery of the correct goods. If the goods have been opened or tampered with in any way the customer will be held liable for any charges or non-credit from our suppliers.
Book Hyperstore reserves the right without prior notice to discontinue any goods.
The Customer will be responsible for ensuring the fitness for purpose of the goods for the Customer's application. Book Hyperstore accepts no liability whatsoever or howsoever in respect of loss, damage or expense arising from errors in information or advice provided, whether or not due to Book Hyperstore negligence or that of its employees, agents or sub-contractors.
The entire liability of Book Hyperstore under or in connection with the Contract with the Customer shall not exceed the price for the goods.
Book Hyperstore shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). If the description of any goods contained in this website or any correspondence, advertising material, or invoice varies from that of the manufacturers description, the manufacturers description will be deemed to be the correct description and shall take precedence over Book Hyperstore description. In most cases, the manufacturers description is available from Book Hyperstore on request.
Any price list, catalogue, advertising matter or similar materials issued by Book Hyperstore are intended only as an indication as to price and range of products available and information therein shall not be binding on Book Hyperstore.
Book Hyperstore provides a "Personal Shopper Service" (Special Import Service) where special orders can be placed from websites/USA based stores or a supplier of a customers choosing, subject to import regulations and at Book Hyperstore's discresion. Book Hyperstore will not be held liable for the quality, correctness or description of the goods. Warranty and product support would be provided directly by the manufacturer/store and the customer would need to contact the store directly for all product queries, warranties and support.
The services provided by Book Hyperstore are only available to those legally entitled to enter into a binding contract. Children under 18 years of age may only use this website with the supervision of a parent or guardian.

DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website.
